Rush Hour Rewards Program Agreement for Northeastern REMC Members

 

Thank you for your interest in the Rush Hour Rewards Program, a service offered  in partnership with Virtual Peaker.

 

Rush Hour Rewards Program allows you to participate in a program for residential members offered by Northeastern REMC (“Northeastern”) called “RUSH HOUR REWARDS” using your Google Nest thermostat. As part of the Rush Hour Rewards Program, Virtual Peaker will remotely inform your Google Nest thermostat of the existence of a Northeastern RUSH HOUR REWARDS event, causing the Google Nest thermostat automatically to change the temperature setpoint in your home on that day without any manual intervention by you.  At any time that you desire, you may override this temperature setpoint simply by turning your Google Nest thermostat to a different temperature or using the Nest or Google website or mobile application.

Your agreement to these terms (“Agreement”) gives Virtual Peaker permission to access and use your energy usage and billing information, to enable the Rush Hour Rewards Program and for Northeastern to enroll you in RUSH HOUR REWARDS, pursuant to the terms and conditions below.

 

Eligibility Requirements

 

The Rush Hour Rewards Program is available to Northeastern residential electric members who meet certain eligibility requirements. In order to participate, you must: (1) be a Northeastern residential electric service account holder; (2) have an 802.11 wireless network at the Northeastern service address; (3) have an active Nest or Google account linked to your Google Nest thermostat; and (4) agree to the terms and conditions set forth in this Agreement.

In addition, (1) if the Rush Hour Rewards Program is offered by Northeastern in the summer season, in order to participate in the Rush Hour Rewards Program during the summer season you must have an installed, operable Google Nest thermostat controlling an air conditioning unit, at your Northeastern service address; and (2) if the Rush Hour Rewards Program is offered by Northeastern in the winter season, in order to participate in the Rush Hour Rewards Program during the winter season you must have an installed, operable Google Nest thermostat controlling a heat pump or a heating system which uses electricity as the primary source of heat at your Northeastern service address.

A Rush Hour Rewards Program year “RHR Year”, summer season, shall be any given year beginning June 1st and continuing through September 30th.  Northeastern members participating in the Northeastern Rush Hour Rewards Program agree that the term of participation shall begin on the date of enrollment of your Google Nest Learning Thermostat and extend for a period of one (1) year (“Initial Enrollment Year”), unless earlier terminated pursuant to the terms herein.  The terms of this Agreement will be automatically renewed at the end of the Initial Enrollment Year and any other Enrollment Year for an additional period of one (1) year (“Enrollment Year”), unless either party terminates this agreement.

 

Incentive(s)

 

Within thirty-five (35) days of your approved enrollment for the Rush Hour Rewards Program, you will receive a credit to your electric bill for $50 per Google Nest Thermostat, maximum of two thermostats (“Enrollment Credit”). For each Enrollment Year that you participate in the Northeastern Rush Hour Rewards Program, you will receive a $50 annual participation credit on your electric bill (“Annual Incentive”) within thirty-five (35) days from September 30, unless participation is terminated by you or Northeastern at any time prior to the end of that year’s RHR year. Maximum of two enrollment rebates per member. The annual rebate can include up to four thermostats. To receive the annual participation credit, no more than three "opt-outs" are allowed per peak thermostat year.

In the event you terminate your enrollment in the Rush Hour Rewards Program before the end of the Initial Enrollment Year, you will be ineligible to receive an Enrollment Credit for any future participation in the Rush Hour Rewards Program. Upon your re-enrollment in the program for a subsequent RHR Year, you will be eligible to receive any otherwise eligible Annual Incentive.

The Incentives are provided solely by Northeastern. Virtual Peaker bears no responsibility for the Incentives. You acknowledge that Virtual Peaker is facilitating your ability to earn Incentives, but Virtual Peaker is not providing you any compensation or other financial benefit, and your permissions to Virtual Peaker are not contingent on receipt or amount of the Incentives. Virtual Peaker makes no promise of any specific Incentive amount. Northeastern reserves the right to seek further information to verify your eligibility for the Incentives.

 

Agreement

 

By submitting this Agreement, you agree that:

Northeastern may share information with Virtual Peaker about your energy usage and associated account and billing data in order for Virtual Peaker to evaluate and improve its products and services. Such information includes, but is not limited to, consumption and billing data, billing records, billing history, meter usage data, and rate information. Your credit card, checking account, or similar payment information will not be shared by Northeastern with Virtual Peaker.

 

Virtual Peaker may share certain information (including, but not limited to, your name, email address, service address, Northeastern account number, Google Nest thermostat serial number, activation date, Nest or Google account status, runtime data, set-points, and related details) with Northeastern and/or its third party contractors or agents to verify that you are eligible to participate in the Rush Hour Rewards Program, implement the Rush Hour Rewards Program, and to evaluate the comprehensive energy impact of the Google Nest thermostat and other Google Nest products and services. In addition, Virtual Peaker may share with Northeastern your decision to opt out of RUSH HOUR REWARDS or your deletion of your Nest account, each of which will automatically result in the termination of your enrollment in RUSH HOUR REWARDS.

 

The information you have provided as part of this Agreement is truthful and you meet the minimum eligibility requirements. Northeastern may terminate this Agreement and not enroll you, or terminate your enrollment, in the Rush Hour Rewards Program if you are not truthful in the information you submit as part of this Agreement, if you do not satisfy eligibility requirements, or for any other reason. You are using Rush Hour Rewards Program on a voluntary basis.

You release and hold harmless Virtual Peaker and Northeastern from any liability, claim, demand, cause of action, damage or expense resulting from your participation in the Rush Hour Rewards Program.

 

This Agreement is effective upon your submitting this Agreement and will continue until you or Northeastern cancels your participation. You may cancel participation at any time during the program by contacting Northeastern.
